On Valentine’s Day 2005, Dr. Anthony Joseph Mauriello Jr. replaced Margaret Rutter’s left knee at Lancaster Regional Medical Center.

Seven months after the operation, complaining of pain and walking with a cane, Mrs. Rutter sought help at Hershey Medical Center.

Dr. William Parrish, an orthopedic surgeon at Hershey Medical, noted that Mrs. Rutter’s left knee replacement was oversized, according to the complaint of a lawsuit filed by Mrs. Rutter and her husband, John, of Marietta.

Parrish replaced Mrs. Rutter’s artificial knee with a smaller implant, according to the complaint.

Claiming the patient had suffered “serious bodily injuries,” the Rutters sued Mauriello for medical negligence on Feb. 7 – just days before the two-year statute of limitations for malpractice suits ran out.

Their lawsuit was not unusual.

Since 2004, patients who believed they were injured during surgery have filed 20 malpractice suits against Mauriello, a local orthopedic surgeon.

That is an unprecedented number of legal actions aimed at one physician in a county whose residents historically have been reluctant to sue their doctors.

No other Lancaster County doctor has been sued more than three times during the period, according to records in the county prothonotary’s office.

Four of the 20 suits against Mauriello have been discontinued by the plaintiffs.

No case has gone to trial.

All of the suits against Mauriello involve knee or hip surgeries performed between 2002 and 2005.
